Purpose:
At its meeting on 13 February 2020, Council
agreed the authorisation of the Housing Director, in consultation
with the Housing Portfolio Holder and Head of Democratic and Legal
Services, to seek possession of Housing Revenue Account (HRA)
properties when required for the Scheme.
Decision:
In accordance with the resolution of Council
and consequential to its decision of 13 February 2020, the Director
of Housing, in consultation with the Housing Portfolio Holder and
Head of Democratic and Legal Services, authorises officers to issue
Notices of Seeking Permission, under the Housing Act 1985, Section
83, at the earliest opportunity on a further 28 properties required
to deliver the blue, cyan and emerald phases of the Sheerwater
Regeneration scheme.
Reasons for the decision:
To ensure the successful delivery of the
regeneration scheme, Notices of Seeking Possession (under Ground 10
of the Housing Act 1985) were served on 19 properties required for
Red and Yellow Phases in December 2020 and a further 9 and 2
properties were served in February 2021 and December 2021
respectively. Recently, Thameswey confirmed in writing that Notices
of Seeking Possessions needed to be served on a further 28
properties to enable the delivery of blue, cyan and emerald phases.
Where possible, the Council intends to continue to work with secure
tenants to mutually agree a suitable move.
In the unfortunate circumstances that the Council is unable to
reach agreement with a secure tenant, the Council may apply to the
court for a possession order under the Housing Act 1985.

Declarations: In accordance with Officer Employment Procedure Rules and in advance of signing this delegated authority, the Director of Housing, Louise Strongitharm, declared a disclosable personal interest (non-pecuniary) in the Thameswey Group of Companies (including Thameswey Developments Ltd and Thameswey Housing Ltd), arising from her position as a Director of the Thameswey Group of Companies. The interest does not prevent Mrs Strongitharm exercising the delegation referred to herein. In accordance with the Members’ Code of Conduct and in advance of sending her consultation response, the Housing Portfolio Holder, Councillor Debbie Harlow, declared a disclosable personal interest (non-pecuniary) in the Thameswey Group of Companies (including Thameswey Housing Ltd), arising from her position as a Director of the Thameswey Group of Companies.
